The trial of a man accused of the murder of a garda in castlerea has heard details of why a doctor's visit to the accused was cancelled.
Stephen Silver is charged with the capital murder of Detective Garda Colm Horkan in Castlerea on June 17th, 2020.
Sergeant Maura McGarry of Castlerea Garda Station was assisting the member in charge of the station, Sergeant David Walsh on the 18th and 19th of June while Stephen Silver was in custody.
Mr Silver had been arrested close to midnight on the 17th following the shooting of Detective Horkan.
He has pleaded not guilty to Capital Murder but guilty of manslaughter due to diminished responsibility.
Stephen Silver had requested a doctor to assess him in the hours after his arrest with a local GP, Dr Greg Kelly attending the station a number of times over the course of the morning of the 18th.
Later that day, the accused had requested a visit of his personal GP based in Foxford, Doctor Thomas O'Ceallaigh.
The Doctor was unavailable and Doctor Kelly again attended the station.
In the 19th of June, during an interview of Stephen Silver alongside his solicitor, it was noted that a doctors visit was required.
Dr O'Ceallaigh was organised to attend before being cancelled later that morning.
In her cross examination of Sergeant McGarry, Roisin Lacey SC for the defense argued that garda records did not show the full picture of who contacted and subsequently cancelled the GP visit and why.
Sergeant McGarry confirmed that the visit was cancelled as a local doctor, Dr Greg Kelly, had attended the previous day and certified Mr Silver as fit for interview.
This was referred to the defendants solicitor, Gearoid Geraghty, who is recorded as having 'no complaints.'
