The High Court is to make a decision today on whether Roscommon County Council breached a court order over remediation works carried out at Lough Funshinagh.
Mr Justice Garrett Simons has been considering the case put forward by Friends of the Irish Environment that the local authority has failed to cover a pipe and restore an area that had been part of a major flood relief scheme in the south Roscommon area.
The programme of works was halted by the court in October, after the necessary planning and environmental reports were not presented.
In the aftermath of that decision, Roscommon County Council initiated a greatly reduced flood relief scheme to drain excess water from the turlough in an effort to prevent homes from being flooded this winter.
Roscommon County Council's legal team is rejecting claims that it breached the orders but has said it would comply with any finding made by the court.
Justice Simmons has stated that should he find the local authority in breach of the order, it would not seek to jail its Chief Executive Eugene Cummins but rather a monetary fine would be considered.
