A well known Roscommon Charity has been successful in their appeal to An Bord Pleanála over the conditions attached to their recent planning approval.
Join Our Boys Trust had applied to Roscommon County Council to develop a new entrance to a home being built for the Naughten family's seriously ill children at Ardsallagh More on the Athlone Road in Roscommon Town.
Works have been ongoing since 2019 to build a specially adapted home for the Naughten brothers, George and Isaac who suffer from Duchenne Muscular Dystrophy, along with their older brother Archie who passed away earlier this year.
The plans called for a new pedestrian and vehicle entrance onto the Ardsallaghmore Cul de Sac from the property, with the homes current access in the Árd Aoibheann housing estate.
The application was the subject of a number of submissions from locals objecting to the plans, including issues such as road safety and fears a second entrance would become a 'rat run for traffic'.
Roscommon planners approved the plan with 7 conditions attached, one being that the applicants will enter into a Section 47 legal agreement with the council.
This would include the limiting of the new vehicular and pedestrian access to occupants of the property and emergency services and the installation of an electronic gate that would remain closed when not in use.
Join Our Boys Trust subsequently appealed the requirement of the Section 47 agreement, arguing that the condition as worded, created uncertainty in the operation of the permission and that the agreement was unnecessary in the case of a residential home.
Following assessment by national planners, An Bord Pleanála re-worded the condition and ordered the removal of a requirement for a Section 47 agreement.]
