Further charges are being considered against the 44-year old Mayo man who is accused of murdering Det. Garda Colm Horkan, a court has been told.

Judge Alan Mitchell was also told at Harristown District Court that a report is being compiled to assess if the accused man is fit to stand trial.

The court was told that Stephen Silver of Aughaward, Foxford, Co Mayo, who is accused of the murder of Det. Garda Horkan on June 17 in Castlerea, is continuing to receive treatment at the Central Mental Hospital.

The court was told that a sick note had been received that the accused was unable to attend court by video link. It is the eleventh time that Silver has been deemed unfit to attend Harristown District Court, which is located beside Castlerea Prison in Co Roscommon.

Defence solicitor Martina Moran of Gearoid Geraghty & Co. Solicitors said the file had been with the DPP for five weeks and she was seeking an update regarding directions.

Sgt. Paddy McGirl said that the case was progressing with the office of the Director of Public Prosecutions.

"Clarification was sought by the DPP on one matter and that has now been addressed and currently being reviewed by the DPP and it is at a progressed nature.

"The DPP is considering further charges," said Sgt. McGirl.

Judge Alan Mitchell said that the case will eventually go to the Central Criminal Court but the initial question was whether it would go to that court to assess whether the accused is fit to stand trial.

Defence solicitor Ms Moran said they were waiting on a psychiatric report in that regard.

"We have a psychiatrist reviewing Mr Silver at the moment but we do not have a report back for us," she said.

Judge Mitchell asked that both sides should give a timeframe in two weeks and he remanded Silver in custody to appear before Harristown District Court by video link on November 20.

"In remanding to the 20th the State might well indicate a timeframe how they are progressing with their investigation and finalising matters to allow a return to the Central Criminal Court, and the defence be in a position to ascertain how they are progressing if the issue of fitness to be tried is going to be an issue.

"I would like in two weeks' time, on both sides, if there was some further certainty on timeframes," said Judge Mitchell.
